CRIMINAL LAW PROCEEDINGS

If you have been charged with a criminal offence, it is crucial to understand the criminal law proceedings that will take place. The criminal law system can be complex and different rules apply to depend on the type of offence. At Neilson Stanton & Parkinson, our criminal lawyers have the experience and expertise to guide you through the criminal law process and ensure your rights are protected.

INVESTIGATION

Criminal law proceedings can be divided into two main stages: the investigation stage and the court stage. The investigation stage begins when a crime is reported to the police. During this stage, police will gather evidence and interview witnesses. If they believe that there is enough evidence to charge someone with a crime, they will refer the matter to prosecution. In all probability, you will be questioned in relation to the case, so we help you by supporting you with questioning and ensuring your rights are upheld.

CRIMINAL CASE

The court stage is where the criminal case is actually heard. This usually occurs in a Local Court, but more serious offences may be heard in the District or Supreme Court. At this stage, both the prosecution and defence will present their cases before a judge or jury. If you are found guilty, the judge will sentence you according to the punishment set out in law for that particular offence.
